The Project consists of two 20-story condominium buildings with a total of 98 units, which sit on a 2-story podium that includes a connecting pool deck and shared underground garage. The Project’s two towers are designated “North Tower” and “South Tower” and rotate incrementally along their height. The construction of the towers consists of composite shear walls, reinforced concrete columns, and concrete floor slabs reinforced with steel and post-tension cables. The Project is located in the Coconut Grove neighborhood along the waterfront near downtown Miami.
VERTEX was retained on behalf of the contractor to respond to allegations of defective design and/or construction relating to site civil, building envelope, structural, mechanical, and other building systems components. VERTEX’s assignment included response to liability opinions, evaluation of the contractor’s standard of care, evaluation of the cost to repair, and allocation of repair cost estimates to parties responsible for the presence of alleged defects. VERTEX, along with other retained experts, developed a more reasonable repair scope for the Project. The Plaintiff’s Estimate for its recommended repairs was over $24 million. VERTEX was critical of the Plaintiff’s recommended repairs, and of Plaintiff’s provided cost estimate. By comparison, VERTEX’s estimate for the Plaintiff’s recommended repairs was just over $10 million and VERTEX’s estimate for the contractor’s recommended repairs was just over $6 million. VERTEX’s efforts assisted in a confidential, but favorable settlement for the client prior to trial.
