Course Description: Per- and poly-fluoroalkyl substances (PFAS) are engineered chemicals that, due to their unique water-repellant, oil-repellant, and heat-resistant properties, have been used since the 1940s in a breathtaking variety of products and industries ranging from food packaging, household products, and cosmetics to water-repellant fabrics, metal plating, firefighting foams, and batteries. Given their durability and widespread uses, PFAS have been detected in people, animals, waters, and lands across the world. But emerging science shows that these chemicals can present serious health and environmental challenges because certain PFAS may be toxic even at extremely low levels, and PFAS are difficult and costly to remove from water and soil.
One context in which PFAS has become a major concern is due diligence for real estate transactions. Considering the increase in new state and federal laws and regulations on PFAS contamination and cleanup, as well as related litigation, real estate developers and investors face unique challenges both in evaluating prospective real estate transactions and cleaning up currently owned properties found to be contaminated with PFAS.
This panel will discuss the most common sources of PFAS contamination in real property, the characteristics that make these chemical compounds difficult to remediate, the current status of these chemicals under the ASTM standard practice for Phase I ESAs, federal and state regulation of PFAS to date, and the litigation risks associated with PFAS for real estate developers and investors.
