The joint venture Engineer/Procure/Construct (EPC) contractor of a Public Private Partnership (P3) tollway in Texas retained VERTEX personnel to allocate the economic damages that resulted from a settlement between the EPC contractor and facility developer for design errors and construction defects. VERTEX personnel allocated the almost $100 million settlement between the EPC contractor’s 20 design and construction subcontractors. We authored several expert reports and provided expert testimony in an International Chamber of Commerce (ICC) arbitration. The arbitration panel awarded our client 100% of the damages we calculated.
