On behalf of one of the nation’s largest coal producers, VERTEX assisted external legal counsel in developing an unsecured claim stemming from the rejection of a number of long-term steam and metalurgical coal supply contracts by a customer who recently filed for bankruptcy. As many of these contracts were 15-20 years in length, the Vertex team modeled the coal producer’s operations into the future to arrive at a logical and reasoned basis for their unsecured claim, which at the time, was one of the largest lost profits claims ever filed in the bankruptcy environment. Ultimately, the coal producer’s unsecured claim was approved by the bankruptcy court and Vertex assisted the coal producer in evaluating settlement alternatives.
