The recent announcement of the addition of two PFAS compounds, PFOS and PFOA, to the list of CERCLA-identified hazardous substances has led to significant uncertainty in the Phase I Environmental Site Assessment and transactional due diligence process. New PFAS-related concerns may mean new RECs – and may also mean re-opening of previously-closed sites. VERTEX and DL Piper will discuss the current state of PFAS in transactional due diligence, with a focus on our recent experiences with PFAS-related concerns identified during the due diligence process, and our view of how PFAS-related concerns are likely to be approached moving forward.
