As part of this year’s program, Vertex Chairman of the Board William (Bill) McConnell, PE, JD, MSCE, MBA, will moderate Seminar 3: Terminations for Default – The Nuclear Remedy on December 10th from 2:45 PM to 4:00 PM in Belmont 4. Vertex Chief Operating Officer Mark Degenaars, LEED GA, will participate as a panelist, alongside Damian Eallonardo, Executive Vice President of W.E. O’Neil Construction, and John Sebastian, Attorney at Watt, Tieder, Hoffar & Fitzgerald LLP.
The seminar will focus on terminations for default (T for Ds), the most severe remedy available to the paying party in a construction contract. With industry-wide T for Ds on the rise following inflationary periods, the session will provide valuable insights into procedural and substantive requirements, strategies to mitigate risks, and ways to challenge improper default allegations. Attendees will also gain guidance on clarifying ambiguities in contract termination provisions during the contract formation stage.
Joining Bill and Mark at this year’s event will be Vertex’s Dayna Anderson, CMA, CFE, Sashi A. Mahtani, CCP, CFE, as well as John Cullian and Rob Peterson from LitCon Group, LLC, which is part of the family of Vertex companies. The Vertex acquisition of LitCon Group closed in November, 2024.
