VERTEX was retained as a surety and construction expert in an American Arbitration Association (AAA) arbitration dispute between an Owner/Developer and the surety of a defaulted general contractor.
The Owner, as Claimant, entered an arbitration demand of approximately $47M, associated with alleged liquidated damages. VERTEX prepared an expert report which evaluated potential prejudice and impairment to the surety and measures that could have been implemented to mitigate damages. The matter settled at mediation prior to the arbitration hearing.
