VERTEX was retained to conduct a claim investigation, review invoicing, and serve as a Fact Witness associated with a gasoline release at a gas station in New Jersey. VERTEX identified that the subject loss had co-mingled with a historical diesel release that had not been completely remediated. The Insured retained remedial contractors to perform the following activities: recovery of free-phase product; installation of a barrier wall to prevent migration downgradient; soil excavation and disposal; implementation of a Classification Exception Area (CEA); and soil and groundwater assessments. Remediation is ongoing. VERTEX was asked to review approximately $997K in remedial costs of which VERTEX identified $122K in disputed costs. In addition, based on VERTEX’s allocation of the sources, approximately $750K were recovered in subrogation.
